Remuneration of record productions in the digital environment

Today, technology facilitates the digital distribution of content in a way that had never been possible before. Even so, legislation has not evolved in parallel and, despite some efforts, has struggled to keep up with 21st century innovations. Moreover, we are now facing another major disruptive challenge brought about by the emergence of Web3, artificial intelligence and new assets such as NFTs. What can jazz musicians and producers do about this?
This session focuses on this new paradigm and sets out the intellectual property rights, image rights and trademarks or other protected distinctive signs that need to be taken into account for a smooth distribution of digital content. It also sets out what remuneration is obtained, and how, from licences and/or authorisations for different rights and through different channels.

Eva Faustino is a practising lawyer at the Il·lustre Col·legi d’Advocats de Barcelona (ICAB). She specialises in Intellectual Property Law and works for major record companies. She is also managing director of the Association of Phonographic and Video Producers and Publishers of Catalonia (APECAT). She is a member of the board of directors of the Catalan Academy of Music, and she writes and collaborates on publications on Intellectual Property Law as well as teaching on various master’s and postgraduate courses in the cultural sector.

The Barcelona musician Guillem Arnedo is president of the Associació de Músics de Jazz i Música Moderna de Catalunya (AMJM), founder and president of the Unión de Músics (UdM) and vice president of the Acadèmia Catalana de la Música. As an artist, he has performed in a wide variety of ensembles in different artistic disciplines, with whom he has recorded, toured and performed, both nationally and internationally. He also leads his own bands and has released five albums under his own name.
